HOW TO ENTER a. The KROQ.com: ALMOST ACOUSTIC CHRISTMAS contest (the “Contest”) will begin at 12:00am Pacific Time (“PT”) on November 23, 2009 and end at 11:00pm PT on November 29, 2009. b. To participate in the contest, you may enter via the following method(s): all entrants must go to KROQ.com and sign into the “Street Team” section. Under the “Street Team” section applicants must select contest on-line and enter to win a pair of pit tickets and backstage passes to the KROQ Almost Acoustic Christmas December 12 OR 13, 2009 at the Gibson Amphitheatre. Watch the KROQ Almost Acoustic Christmas “mashup” video followed by listing all 16 bands in the order they appear in the video, each entrant must select night 1 or night 2 on the entry page to win. Only one internet entry per person and one internet entry per email address is permitted. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning an email address or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address. All entries submitted become the sole property of the Station and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Station. Station’s computer is the official time keeping device for the Promotion. The Station is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties and other technological problems. All entrants must agree to the Station’s online submission release in order to submit his or her entry. 2. ELIGIBILITY RESTRICTIONS a. The Contest is open to all KROQ listeners who are 18 years of age or older and who legally reside in the State of California. Grand Prize winners must be over 21 years of age to participate in the Grand Prize Contest. Employees of KROQ (the “Station”), its licensee, its corporate parents, subsidiaries, and affiliates, its advertising agencies, participating sponsors/promotional partners, other radio stations in the Los Angeles metropolitan area and the members of their immediate families and/or households are ineligible to participate or win. b. Listeners are eligible to win a prize in a Promotion conducted by the Station only once every thirty (30) days and only once every six (6) months if the prize is valued over $600. Only one (1) winner per household is permitted in any Station promotion. c. In order to participate in the promotion, participants must have a valid driver’s license, state identification card, military identification card, or valid passport; complete all entry forms and questionnaires, and sign a liability, publicity and participant release form when submitting their entry and/or prior to being selected. 3. PRIZES a. Two (2) Prizes will be awarded. Each prize is two (2) pit tickets and two (2) backstage passes to the KROQ Almost Acoustic Christmas December 12 OR 13, 2009 at the Gibson Amphitheatre. The Approximate Retail Value (“ARV”) of each Prize is: $150.00. b. There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply. 4. WINNER SELECTION AND NOTIFICATION a. Decisions of the Station management with respect to the Contest are final. b. Contest runs on 11/23/09 12:00AM and ends on 11/29/09 11:00PM during all day parts. c. Listeners may apply at KROQ.com under the Street Team section. Grand prize drawing and notification will take place on 11/30/2009 @ 10:15 am by the KROQ promotions department. d. The odds of winning this contest depend on the number of entries received by KROQ and the number or correct answers on the challenge. All 100%’s (as if it’s a test) will qualify to win pit tickets and backstage passes to the KROQ Almost Acoustic Christmas. e. Winners must execute and return any required Affidavit of Eligibility/Release of Liability Prize Acceptance Form within ten (10) days of notification attempt or prize will be forfeited and an alternate winner may be chosen at random by KROQ. 5. CONDITIONS a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize. b. By participating in the Contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize. c. Prior to awarding any prize or prize certificate, the Station in its sole discretion may require Contest winners (and their travel companions, if any) to sign a liability release, agreeing to hold the Station, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Contest. d. The Station reserves the right to make changes in the rules of the Contest, including the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the Contest and shall not be required to award a substitute prize. e.
